I've been ripped off by a con merchant who recieved my items then claimed a full refund lying that they are damaged goods.
He now has my items free.
How is this even possible?

If he opened a not as described case, damaged in transit, and you used simple delivery, then ebay would refund, NOT YOU.
It is up to ebay to do their own checks as it seems to me they will be ripped off instead of the seller if they do not do some checking.
If you refunded, then I doubt you will get your money back!
How do you know items were not damaged in transit, as if you dealt with refund, then you would have had to provide a reply paid label, and not refunded until received back.
It is up to sellers to know how systems work and use them correctly.

Unfortunately the false positives you left a buyer calling criminal can seriously damage your account.

It's possible, indeed the likely outcome, when a buyer opens a case using the money back guarantee and the seller fails to respond as ebay expects them to.

I would never call somebody a 'criminal' in public domain, you could end up with some very expensive legal action.
