Tyres not as advertised

Bought 2 part worn tyres prior to buying a swt of 4 new tyres in a few months. The 2 tyres the seller stated had been pressure tested etc and the pictures showed the condition to be relatively good.

 

On arrival I paid to have them fitted to the rims, the discovering the side walls were cracked and perished. Clearly not acceptable. I understand buying used tyres there is a risk,  but from sellers description and pictures, this fault was missed by the seller and they have admitted they missed it. 

 

The seller offered a partial refund, which air don't want as I won't be using the tyres now. The trouble is by the time I have paid for fitti g and will have to pay to get them taken off, that's a large percentage of what I paid for the tyres anyway. This seems unfair that I will be financially worse off when it is the fault of the seller and something they missed. I have tried to speak to a human at Ebay, but keep getting the Ai assistant wanting me to simply return the tyres.

 

Can anyone offer any help on what to do?

You can open a return and send the items back at the seller's expense.

Ebay won't get involved with further claims, such as the expense of having the tyres fitted.  You will have to discuss that directly with the seller.

eBay's buyer protection/Money Back Guarantee allows buyers to return items within 30 days for a full refund.

 

If an item isn't as described then the seller must accept the return, and pay for the cost of the return postage.

 

The seller may offer a partial refund, but that would be down to the buyer as to whether they want to accept it, or not.

 

In your position your options are to a) remove the tyres and return them for a full refund within the time period, or accept the partial refund that the seller is offering.

 

Another option would be to get something in writing from the garage to confirm that the tyres do not match the listing description (though there may be an argument there that this is something they should've noticed before fitting them) and issue a chargeback via your debit/credit card provider (if you paid that route).

Sorry, I've just looked at your pic - that is something the garage should've noticed before fitting, I can't believe that they just went ahead and fitted them and then went 'hey look'.
