Returning goods from abroad without accepting or paying duty

Okay item arrived late and subject to duty not previously disclosed. Return agreed by seller but I have to attach their returns paperwork and don't have item. Carrier says if not paid duty in 20 days they'll return if they send back immediately on the 20th day it only gives 6 days to get back to meet sellers deadline. Have been arguing with seller for a week after late contact by carrier. Not able to contact ebay anymore as they say they've done their bit.

How do I proceed?

If you don't have the item open a "not received" case to get your money back.

As the importer of goods, you are responsible for import fees,

It is up to you to know this  not the seller, although most international listings do have warning.

Failure to pay import fees invalidates ebay MBG, so you could lose item and money. 

If seller is willing to accept return,  it is between you two.

It sounds as though you're refusing to pay the duty becaue you want to return it?

 

If so, and the item is returned to the seller because you failed to pay any import charges it will be disqualified from eBay's money back guarantee. You will lose any right to a refund through Bay.

 

You need to accept the delivery and pay any import dues. You can then use eBay's money back guarantee, although if your claim relates to late delivery the lenght of time for which it was held up by your delay in paying may be an issue. If successful, you may need to claim the import duty back separately through HMRC.
