I recently purchased a Garmin running watch from a business seller, described as being "an ideal companion for running and jogging" and "tested and is fully operational". Hours after charging and setting up, I found that it switched itself completely off as soon as the activity start button was pressed - so hardly "fully operational" or "an ideal companion for running"
The seller has many other copies of the same watch, in the same and different colours, with near identical descriptions, and I am keen to try to prevent other people being similarly scammed - even though i have a refund label, the return cost will be mine and there is the disappointment and waste-of-time to consider also. How do I get ebay to take action to make the seller remove its faulty, mislabelled items or at least clarify the listings?

Why is return cost going to be yours?
If you open a NOT AS DESCRIBED RETURN CASE, the seller has to provide a return label and on return refund in full.

eBay will take any necessary action if you, and all the other buyers open a case for item not as described, when receiving this item.
If there are too many cases for the same reason resulting in too many refunds, this will raise red flags to eBay who can then place selling sanctions, or a ban on that seller's account.
If you haven't done so already, and if you are still within 30 days of the item's last estimated date for delivery you are guaranteed a full refund, under eBay's 30 day MBG, Money Back Guarantee policy.
You have received an item not as described, go right of the item in your Purchase History and from More Actions select... Return this item selecting the reason Item Does Not Match Description or Photos.
The seller needs to accept this case within 3 days and refund, if they want their item back first , they need to pay for that fully tracked return postage, then on receipt of their item they have 48 hours to refund you. If they don't , need to escalate the case, ask eBay to step in, and they'll force the refund.
Never listen to any excuse or promise from the seller to close the case early, and do not forget to escalate.
