Pre order not delivered and seller doing all they can to not help

Purchased a pre order model August 2024.

item has been released to the UK market beginning of August 2025 and is available with other sellers on here and websites. 
seller said would be mid to late August due to it being en route with their supplier.

No response from subsequent enquiries. I requested a refund due to now personal circumstances and was told it’s not possible due to eBay rules. Delivery dates have been changed. Option in drop down menu to request eBay step in is not available. Am slightly miffed to say the least. 
Any advice appreciated.

If you purchased in August 2024 you are far too late to make any claim now,all presale order must guarantee postage within 40 business days of purchase.

Apart from rules on delivery dates, ebay’s money back guarantee is only for 30 days, and payment provider only likely to help for 180 days.
