Pre order item listed as dispatched before it is available for release. Seller advised the below.. I’m quite new to this so just checking whether this is normal?

 

“We have to purchase the shipping labels within 7 days of sale

We purchase two shipping labels

One is to send out a confirmation of order to all customer who preordered

The other will be a next day delivery for delivery upon release date

Stock is due in to us for the 12th November from our distribution company Asmodee and we are allowed to send out on Thursday evening via next day delivery try for delivery upon release date of the 14th November”

Sounds wrong to me.

First of all, only a seller with a business account should be selling pre-orders.  If this seller is trading from a private account, that is a red flag.

Secondly, sellers have to give an accurate (roughly) estimated delivery date based on when the actual item sold should arrive with the buyer.  The item has to be posted within 40 days of purchase.  that doesn't fit in with having to post within 7 days of the sale.  Red flag number 2.

Sending a confirmation is not usual practice.  If you don't get the item you pay for and open an 'item not received' case, the seller has proof of delivery to you.  Although what you have received will not be what you ordered.

Have you paid?

What is the estimated delivery date shown on the listing?  Not the November dates given in messages. the date on the listing?

Ahhh man that doesn’t sound good.

Yes I have paid via PayPal.

The tracking says it’s arriving by 23rd October. Do you suggest I contact
eBay and details ‘item not as described”, in order to get a full refund
under the money protection guarantee?

With a delivery date of 23rd October, you would be able to open a case for 30 days after that.

What (sometimes) seems to happen is that the seller then starts to make excuses and keeps changing the date when your item should arrive, until you find you are out of time to do anything.

Unless you are entirely convinced that your seller is genuine, you can request a cancellation and refund.

If they refuse, then you can open a 'not as described' case when you get the confirmation of order that they post to you.

one day after the last estimated delivery date open a not received case.

I am definitely a bit sceptical. I can’t do a cancellation as the item has
been marked as dispatched.

I asked the seller that I would like to cancel and whether they can cancel
their end, but they have asked that I open a return request.

Is that the best possible option? Although I will have nothing to return
other than the letter confirming the pre order..

You can't open a return if you haven't received it.

1 day after estimated date open item not received case, escalate on day 4.

Ignore seller excuses.

No it is not possible. Once opened and you have nothing to return case will close and no refund. You then cannot open a not received case.

 

Open a NOT RECEIVED CASE as soon as past the expected delivery date. 

 

This whole transaction sounds fishy, marking as dispatched when they have nothing to dispatch, give you the ability to get a refund. 

 

DO NOT DO anything this seller suggests without checking here first, as it sounds like a con.

I will follow your suggestions and open an item not as described case after 23rd October and escalate as required, in order to get my funds returned.
