Please help, cant seem to speak to a human

I sold a bnwt jacket just before Xmas. When the buyer received the jacket he said it had no tags so wasnt new. I pointed out that the tags were clearly shown in the pics and all of a sudden he miraculously found them.Unfortunately I have end stage liver disease and then went into hospital for 11 days. When I got out I discovered that he was no saying the jacket smelled of smoke and hee wanted a refund. I'll just point out that I live in a smoke free house. I then discovered ebay had already swallowed his lies and found in his favour. I thought ok no problem just send the jacket back and I will refund but apparently he doesn't have to send it back and he hasn't and i just have to let him keep a £160 jacket and give him his money back. Surely this can't be right but ebay have closed the case. How the hell do these scammers get away with it. I refuse to refund this fraud whilst he still has a brand new jacket but ebay are threatening sending a collection agency to my door. I'm a very ill person and don't need all this hassle. Surely there must be something I can do.

If a case is opened, if seller does not respond within 3 days, then buyer can escalate to ebay, who assume return is not required and a refund is made at your expense and you get a defect.

 

Depending on how you packed, I understand that some of the black plastic wrappings do cause, contents to smell of smoke, so buyer msy not be a scammer.

 

If you want item back you will have arrange with buyer and provide a paid for return label, or send money, although not recommended as he may just keep the money.

I am sorry about your health. 

But ebay are not so kind.

If buyer opens not as described case, you have 4 days to issue returns label and refund on return. 

If you don't do this, ebay refund buyer and they keep item.

Ebay will quickly pass debt to collection agents.

I suggest you contact eBay and explain, hopefully they will be sympathetic. 

Do it 1st thing in the morning, should get Dublin, better than Philippines.
