Not original battery in phone ,draining very quick

Just purchased an I phone 11 pro for my son he wanted as a present, he has had a new screen protector fitted and bought a case literally had the phone a few ,on the screen it shows the battery is not genuine, so not an original apple battery like it should be . It is draining very quickly I've asked for a £30 refund to allow for a new battery to be purchased, but they said send back for a refund, if I do this they will just sell the same phone to someone else and rip them off , trouble is my son has just bought a screen protector and case for the phone ,why won't they give a part refund, how do I open a case on ebay please .

Are you still within 30 days of the item's last estimated date for delivery?  Then proceed this way:

 

You have received an item not as described,  so you are guaranteed a full refund under eBay's 30 day MBG,  Money Back Guarantee policy,  if you claim within 30 days of the item's last estimated date for delivery.

You then go right of the item in your Purchase History,  and from More Actions select Return this item,  selecting the reason...  Item Does Not Match Description or Photos.

The seller has 3 days to accept the case,  if they don't ,  you need to  escalate on day 4,  or within 30 days,  and eBay will step in and force the refund.

If the seller wants the item back first,  they need to pay for a fully tracked return postage.  On receipt of their item they have 48 hours to refund you.  Again,  if they don't,  you escalate the case.

Do not close the case early for any excuse or promise the seller may give,  and do not forget to escalate.

Sellers aren't obliged to offer a partial refund (though in this situation it would seem the most sensible thing for them to do), so your only option is to open an eBay return and send it back (at the sellers expense) for a full refund.
