Sent brand new mobile back as plug overheating (this was after seller agreed)

Phone sent back Monday afternoon , So arrived with seller Tuesday afternoon
Low and behold Wednesday about 2pm a e mail saying nothing was wrong with phone and will be sent back ? It's a hazard
E bay and pay pal no refund over 30 days but mobile bhas 1 year guarantee
And why change cable if ok ?
