Missing item ,seller became abusive when I questioned

tracking on item said delivered and photo shows an item left leaning against my bin on my drive. I was expecting a boxed pair of shoes. The picture was a small package. When I questioned the seller. I was told unbelievable story that Royal Mail take them out of the boxes and re-wrap them I then began to question The authenticity Of the item and the seller became abusive opened a case with eBay also with PayPal then eBay cancelled my case and PayPal found in sellers favour as tracking shows as delivered. Royal mail will not deal with me as they say it’s just the sender who has to claim, but the sender is refusing to help

This is confusing.

Did you contact the seller based on the picture or did you actually get the parcel?

If you received an item and it was not what you were expecting, you needed to open an 'item not as described' case as something was delivered to your address.

When you opened a case with Paypal, it automatically closed your Ebay case; you can't have two cases open at the same time so really, there is nowhere now for you to go.

If you open a PayPal case while you still have an eBay case open, the eBay case will be cancelled and can't be reopened. If the tracking record stated that the item had been delivered, neither eBay or PayPal will refund you. The seller's responsibility is to deliver the item - what happens to it afterwards isn't covered.

 

I'm afraid that you accepted all of this in the user agreement. Delivery problems have become one of the biggest risks of buying on eBay. The whole parcel delivery industry has become like the Wild West. Parcels are routinely left on the doorstep to be seen and stolen, or (surprisingly often!) left in wheelie bins which are then emptied, or simply delivered to the wrong address. Companies like eBay and PayPal can't investigate every individual delivery and their t&c state that claims will be decided according to the tracking record.

 

PayPal has an appeals procedure, which you could try. Good luck!
