Litigation

A buyer is threatening to litigate for breach of contract because I cancelled the sale of an item they didn't collect on the first scheduled date and then rescheduled the collection date of twice more. I lost my patience. I am a private seller clearing unwanted stuff, on this occasion prior to moving. I'm not a shop. I've cancelled all my other listings for fear of similar reprecussions on other collection only items.

Most threats of legal action here are just bluster by people who don't know what they're talking about.

If this is the £30 used leaf blower you sold on 18th august, you can forget about it. £30 isn't worth legal action, and in any case all they could claim for is losses caused as a result of your cancellation. What losses? Plus they apparently they failed three times to collect it.

We don't know how they paid or whether you have refunded them, but assuming that you have done so it's hard to see what claim they have against you. Ignore it, but in the unlikely event that they start legal action see a solicitor, or perhaps start by asking Citizens Advice.

What a numpty!

Quite honestly they sound ridiculous and I certainly would not have ended all my other listings on the basis of this.

As Red Magpie says you should ignore it as I think they would be laughed out of court anyway.

It will come to nothing but make sure you print off all the messages, just in case you need them.

If anyone breached the contract they did.
