Seller won't send correct images for a used item 156639818218 and is using new manufacturer images, they state that the images form part of the description and condition. Can they misrepresent in this way?

The seller is being a bit silly here if those images show a Brand New item, they are opening themselves up for an item not as described case, because if you proceed to buy and find the item has any differences to the photos shown, that are not acceptable to you, you are guaranteed a full refund under eBay's 30 day MBG Money Back Guarantee policy.

Business sellers who sell multiple items often use a stock photo. They sell hundreds of items every month and probably don't have time to take lots of photos.
If you buy from that seller, you will have to accept that the photo won't be of the actual item you receive.

eBay wouldn't see it as misrepresentation. eBay now allows any seller to copy and use any other seller's picture of a similar item - and requires all sellers to allow this. How can eBay not understand how much it will damage its credibility when buyers realise that photos here, even of used items, may not even be of the actual item being sold?
eBay certainly tries not to make this apparent to buyers. They now prohibit sellers from watermarking photos or identifying them in any way that would reveal that they have been copied.
