Item damaged during delivery

A vinyl record I  have recently sold was left outside the buyers home with no notifications and was left out overnight and damaged by the rain, 

 

the item was accidentally listed as being a red coloured vinyl as I just followed the “sell one like this” option and didn’t revise the listing 

 

the record in question doesn’t even exist in red but I admit that is an error on my behalf, 

 

the buyer wants me to refund the full  amount of the purchase and to return the item 

 

I obviously don’t want back a damaged item due to evris negligence.

 

i would of course agree to offering a full refund if the item wasn’t water damaged

 

any advice much appreciated

Putting the damage to one side, you mis-sold this item and the buyer is entitled to a full refund on the basis that the item is not as described in the listing.

If the buyer opens a case, you can either refund in full or provide a label, get the item back and then refund in full.

Then, you can pursue your claim for damage against the carrier.

Even if the item was not mis-described, you would still be liable to refund in full because of the damage, and then pursue your own claim against Evri, UNLESS the item was sent using Ebay's Simple Delivery.

The item was sent by eBay’s simple delivery service

I think Evri offer a sub standard service and would not use them personally
