Item arrived broken - what to do now?

I bought the item from seller X. Unfortunately the plastic box of the DVDs got broken in half, which was fine on the seller's side. How can I open an issue of the broken item? I can only request the return, which the seller does not accept (It was mentioned on the auction).

All sellers have to accept returns for  "not as described" returns, they also need to supply return postage labels.

If sellers could refuse all returns, then they could send out any old broken rubbish.
