Hello, I ordered an item but opened a return, the buyer wrote that he will try not to send the package, I am trying to contact him, the dispute was closed by ebay, I have neither the money nor the item so it is clear that I have been cheated, what can I do in this situation

Not sure how you opened a return if you hadn't yet received the item?

Do you mean you asked the seller to cancel the order and they didn't?  Then,  proceed this way:

Has a reasonable time passed your item's last estimated date for delivery,  and you have not received the item?

Then,  if the seller is not being helpful,  go right of the item purchased,  and from More Actions select....  I Have Not Received My Item.

If you are not fully refunded within 3 days,  you must escalate the case on day 4 or within 30 days from opening the case,  and eBay will step in and force the refund.

Do not close the case early for any excuse or promise the seller may give,  and do not forget to escalate.

according to the messages you post here the seller refused your cancellation request as the item had been sent and they told you to return for a refund when you got it.

You say you have opened an eBay return case, so you can use that case if and when you get the item before the case times out.

No, it isn't. What clear is that you didn't follow eBay's return procedures correctly. You can't start a return for an item that hasn't even been delivered. To receive a refund you would have to return the item that you don't have! If the request was closed you won't be able to reopen it.

If it isn't delivered you can open an item not received case, but not until after the latest estimated delivery date has passed. Hopefully you will still be able to do this.
