The seller is selling fake products (Batterys that are not the spec they are sold as, and after a few months stop working). After contacting the seller all they send a whats the order number then nothing.
As it took a few months to find out these are not working and not fit for purpose, UK law entitles me to a full refund. Ebay and Paypal wont entertain this as its is past the 30 day guarantee and have enabled this sort of scam to run.
Ebay have removed the listing, but since this seller had my details I have now been targeted with multiple phone calls a day from scammers. Fortunately I dont use my phone that way so it is easy to ignore.
Ebay must have some part to play, but the robots jeep closing anything I try. This is my last hope.

Had you forgtten that eBay warns buyers in the user agreement (section 2) that they do not guarantee the quality of items sold here, that they will be truthfully described, safe or even legal? Would you have bought this battery from a shop that stated this??
eBay is a risky place to buy aftermarket batteries, which are notorious for being poor quality and sometimes even dangerous copies from China. However, as you correctly point out, by the time you discover this it will be too late to claim under eBay's own, 30 day money back guarantee. So any rights you may have under UK law will be against the seller and not eBay.
There are plenty of known reputable retailers and online stores where you can shop safe in the knowledge that they are properly guaranteed and subject to UK law statutory consumer protection.
It was your choice to buy batteries here, and you can't say you were not warned about the risks.
You haven't told us when or how you paid? If within about 90 days your payent provider e.g credit or debit card provider may still be able to help. If you paid by credit card and the item cost over £100 you may even have the added protection of the consumer credit act.

You are very assumptious and very patronising. Maybe you should check your ego and re-evaluate how you talk to people you do not know.
According to your logic, it should be safe to sell illegal items as long as you warn people in a ToS. But this might surprise you, can not over ride any UK Law no matter how clever you word stuff.
Consumer Rights Act 2015 — gives you statutory rights as a buyer that eBay's ToS cannot remove or limit. Any clause attempting to do so is unenforceable. I have found a human at PayPal who is going to sort it out.
Try to be better. I have no interest in engaging you any further.

Sorry but your dispute is with your seller now, not ebay. Ebay are just a platform for sellers to advertise their goods, a bit like your local corner shop who might put a postcard in the window for you.
You may be able to ask your bank to help, but as Red Magpie says, it depends on when and how you paid.

Thank you guinevere. Paypal are investigating. Their system closed the case too early in error.

Given that PayPal also have protection that is limited to 30 days for item not as described claims, that is surprising.
