False advertising

A person is advertising an item for sale they do not own. I advertised an item for sale on a Facebook group I belong to and the photos have been taken and used on eBay. The item is very distinctive. The eBay seller is saying the item can be collected from a different part of the country. How can this be stopped as they are committing fraud?

You can try reporting it; there is a link in every listing to report it.

 

Don't be surprised if eBay takes no action. In the user agreement eBay explains that listings are the responsibility of the seller and makes clear that "they do not guarantee the existence, quality, safety or legality of items advertised, or the truth or accuracy of descriptions".


Buyers can't say they were not warned about the risks of buying here. However, if an item is not as described the seller can return it under eBay's 30 day money back guarantee.

 

If the owner report the listing eBay will deal with thus under their stolen items policy. You can find this in the help and contact search field, but my recollection is that eBay will advise them to report it to the police and obtain a crime number. eBay has procedures for assisting the police when requested.
