I CONTACTED A SELLER WHO GUARANTEED THAT HIS PRODUCT WAS FIT FOR PURPOSE AND WOULD REFUND IF FOUND DEFECTIVE - I DOUBLE CHECKED WITH HIM AND HE RE ASSERTED HIS PROMISE - THE ARTICLE DID NOT WORK - I CONTACTED HIM AND HE MADE VARIOUS SUGGESTIONS - HE SENT ME AN E BAY RETURN STICKER AND I RETURNED THE PRODUCT IMMEDIATELY/WITHIN ITS PRINTED LIMITS - E BAY SAYS IT WAS A FRAUDULENT RETURN FORM AND HE STILL HAS THE PRODUCT AND MY 350 POUNDS - E BAY REFUSE TO HELP - THIS CHAP/COMPANY IS STILL OPERATING ON E BAY PRESUMABLY UNREPENTANT - E BAY HAVE, DELIBERATELY IT SEEMS BEEN USELESS - I WILL PERSUE THE SELLER VIA THE COUNTY COURT BUT IT SEEMS UNFAIR THAT I SHOULD HAVE TO

Did you open a return on ebay, using the reason "Not as described"?

Unless you did this you have no way of insisting on a refund.

 

All I can suggest is that you open a case now, and add the tracking number of the item you returned. You would have to contact ebay CS to do this, try contacting them here

 eBay Customer Service

Explain to CS what has happened and ask them to add your tracking number to your case. And then ask them to close the case in your favour and they should refund you. 

 

Always go through an ebay case for a refund, that is the on;y way you can be sure of being refunded.

Any guarantee that a seller gives is between you and the seller. Nothing to do with eBay.

 

Perhaps you didn't you read Section 2 of the user agreement, which warns buyers that  "eBay does not guarantee the existence, quality, safety or legality of items advertised, or the truth or accuracy of descriptions". You knew, or should have known, the risk you were taking.

 

You have given us no dates or other information that may have helped us to advise you - not even the date of purchase, how you paid and and whether the seller is a UK business seller.

 

Assuming that it's beyond eBay's own, 30 day money back guarantee period, you may still be able to get help from your credit or debit card issuer, if that's how you paid. Otherwise, your prospect of succeeding with a case in the small claims court would depend on many things, none of which you have told us. If thinking of going down this route, I would advise first consulting a solicitor or at the very least Citizens Advice. Good luck, anyway.
