Why can't I close my account ? I've had 40 quid in my funds for last 8 month that it won't let me access because I won't enter tax details so I'm done with it but it won't let me close acc

I think you have answered your own question.

Accounts can only be closed when they are free and clear of any issues.

eBay will still have to report your sales if you have sold over €2000 (approx£1700) even without you giving them your NINO.

Why wont you supply the details,get your payout then close the account?
