Are you aware that selling a car on eBay under trade is illegal in the UK.

No seller can sell without a legal come back if the car is faulty.

When you sell a used motor vehicle to a retail customer, you are entering into a legally binding contract. The customer has the right to expect the vehicle to be of a satisfactory quality; fit for the purpose, and, as described.

As a trader, misleading consumers by using phrases such as “Trade Sale – Sold as Seen” or “No Refunds” is not only illegal but also completely voids the contract.

The only occasion whereby this term could possibly be used, is for private sales. A private sale is defined as a private individual selling to another private individual, not a trader selling to a private individual.

For dealers selling used vehicles to other traders, it is a pointless activity using the term ‘Trade Sale’ as this is implicit, i.e. stating the obvious. In short, “Trade Sale – Sold as Seen”, should never appear on your customer invoices unless you would like a meeting with your local trading standards officer and it is a waste of your time if you are selling to another trader. So, don’t do it – you have been warned!

If you sell a vehicle under £500, You can state sold for spares or repair.

This also should state to be trailered away.

Thus giving indication the vehicle is purchased in a non road worth condition.

Only then it is accepted as a no warranty sale as long as under £500 pounds only

.

It's only illegal when done on an ebay private account,  when it's actually illegal to trade in anything, not just cars.

So is selling a car that doesn't even exist, but that doesn't stop criminals from doing this.

 

eBay motors is a magnet for criminals. In a TV programme about organised crime, a senior police officer reported that one criminal gang alone had registered "multiple hundreds" of fake accounts on eBay to place fraudulent listings for non-existent motor vehicles.

 

As for being illegal, eBay specifically warns buyers  in the user agreement that "they do not guarantee the existence, quality, safety or legality of items advertised, or the truth or accuracy of descriptions".

 

And of course motor vehicle sales are excluded from eBay's money back guarantee. eBay is a very risky place to buy a used car. Yet so many buyers have been conned into paying for vehicles they haven't even seen.
