Are you sure you have given enough time for the escalation option to appear?
Once a case is opened it gives the seller 3 days, that is exactly 3 x 24 hours to respond. If it's a case for item not as described, and you've sent the item back, this gives the seller 48 hours to refund you, only on receipt of their item.
Those times are timed to the very second, so you may be looking a little too early.

Are you still within 30 days of the item's last estimated date for delivery?
If so, then the seller cannot refuse to refund you if you received a faulty item. Listen to them no more but just proceed this way:
You have received an item not as described, so you are guaranteed a full refund under eBay's 30 day MBG, Money Back Guarantee policy, if you claim within 30 days of the item's last estimated date for delivery.
You then go right of the item in your Purchase History, and from More Actions select Return this item, selecting the reason... Item Does Not Match Description or Photos.
The seller has 3 days to accept the case, if they don't , you need to escalate on day 4, or within 30 days, and eBay will step in and force the refund.
If the seller wants the item back first, they need to pay for a fully tracked return postage. On receipt of their item they have 48 hours to refund you. Again, if they don't, you escalate the case.
Do not close the case early for any excuse or promise the seller may give, and do not forget to escalate.

No I'm not but I did contact the seller within 30 days asking the item was counterfeit! With photos, eBay seem to ignore counterfeit goods!!

eBay do not ignore counterfeit good, for one, it's totally illegal to sell such goods anywhere in the UK, not just online.
eBay cannot act on messages from members, as they could be coming from disgruntled buyers, even a competitor accusing a seller of selling fake goods, to remove them from the site, and remove their competition.
eBay act on cases.
You were in time then to open a case for item not as described, no point messaging a seller, just go straight to a case for this reason, as a seller is not going to admit to selling a fake to you.
If several of these cases are made by buyers, it raises red flags to eBay, brings to their attention of counterfeit item selling, and the seller can then be removed from the site permanently.

They have closed the case in the sellers favor, other feedback comments have mentioned they don't think the items are genuine.

Sounds like you were past eBay's 30 day Money Back Guarantee timeframe then.

As @61stephenuk says.
It does not matter that you "contacted the seller within 30 days". Some sellers may even delay or give bad advice or "promises" so that they run you out of time.
The case needed to be opened within the 30 days. In my view it is pointless contacting the seller as all must be done through a case. Opening a timely case notifies the seller and eBay
Please believe that eBay will not now help. You may be able to get recourse through your payment provider.

Case has to be opened within 30 days, seller has 3 FULL DAYS 72 hours to respond, if not then you can ask ebay to step in.
You cannot ask ebay to step in if case closed because it was opened too late.
