Advice on an item bought

Hi, I received an item I don’t believe is genuine. The seller has offered me a £5 refund (item cost £40), which I don’t want to accept. Should I decline and wait for eBay to step in?

Have you opened a case for not as described?  If so, then decline the partial refund and wait for a returns label, if one doesn't come, escalate to ebay.

Do not close the case on the basis of any promises by the seller.

Ebay will not step in automatically. First you have to open a not as described case, and if the seller does not supply a return label within 3 days, on day 4 ESCALATE to ebay.
