refund request suddenly closed?

Had an issue with a seller over last few days whom I bought a denim shirt from.

The listing and header stated clearly that the size was 52" chest and when arrived it was too small.

I measured the shirt , which is 100% not stretchy , and it measured 50".

Messaging to and fro took place which the seller had no intention of admitting fault , saying denim stretches with wear! [ even though this is a used item].

Suddenly tonight the return request was closed , by who I dont know , but certainly not me.

Was this E-Bay that closed the return? , if so why would this be and why not offer reason?

I dont see any way to dispute this action without calling e-bay up.

Surely this is an item not as described.

Did you open a Case within 30 days of Delivery? Did you open a Case for Item Not as Described?

If you selected "Does Not Fit" that is Classed as a Change of Mind Return. Private Sellers who state "No Returns " can Refuse Change of Mind Returns.

I did open a case and complained to the seller on the day the item was received. The day later, yesterday after several messages back and forth, I was advised by e-bay that the return request was closed?.

I was not aware that a case could be closed by the seller who does not offer returns policy and therefore not allowing you to continue the return request. This cant be right surely?

I contacted ebay this morning and was advised that as the buyer does not accept returns , though item was not as described, I would have to seek help through my credit card company?

What happened to the E-Bay buyer protection scheme?

So contacted E-Bay again as was unsatisfied with first response and the lack of clarity.

Again I receive no answer when asking why the "return request was closed"., although the reason was disclosed as buyers remorse verbally, there has been no explanation written to me. I cannot appeal the decision therefore!

I received an item which stated a chest size which was wrong , I returned a picture showing it was two inches smaller and did not fit.

Why on earth would this be considered buyers remorse? , and how can I possible appeal the decision if I do not receive notification from ebay?
