"Cancellation for this order is pending", hacked account, order paid but no refund

Hi,

I bought an iphone from one "Top-rated seller" yesterday for 300$ around and I paid him with paypal just after. Probem is few hours late the seller cancelled the order because he said his account has been hacked and payment done with Paypal to wrong address. No luck already.

On Paypal history, my transaction is written "completed" and usps tracking shipping number is incorrect as different country and wrong dates.

Now seller asks me to accept the refund on ebay but to accept choice of answers looks not good as I paid already and I didn't receive any refund on my Paypal. (see below)

After asking to seller some explanation he suggests me to create som Paypal claim to get refund. Another problem is if I do a claim with Paypal in ResolutionCenter then my eBay claim will be cancelled.

What can I do ? Thanks for your help

In these particular circumstances a paypal claim is your best bet as it doesn't sound as if ebay would have access to the paypal account to claw the payment back from, if it wasn't linked to the transaction, or the seller's account.

It won't matter that the ebay one closes.
