I'm so angry. I waited to escalate the case and all eBay have done is close it and are asking me to pay to return the fakes to the seller who will definitely resell them!
Returning is my only option if I want my money back, but I've been told this is illegal so I'm not keen. 
I can't speak to anyone about it, it's the most frustrating experience ever

the only time a buyer has to pay the return costs is for a change of mind return.
That would explain why eBay have not taken note of your proof/evidence.
If you opened a not ads described case then the seller would have to pay the return cost, but, eBay would/should have taken note of your proof/evidence.
The fact that you are expected to pay the return costs points to you opening the wrong type of case.
It isn't clear what you mean by eBay "asking you to return fakes". Are you referring to the ordinary, routine default that disputed items must be returned to the seller before a refund is made? Or did you explain the circumstances to eBay, and offer to provide proof that the item was fake?
If you read eBay's money back guarantee policy, you will see that the requirement to return counterfeits may be waived with eBay's agreement, and on production of evidence.
Otherwise, eBay will still support a buyer who claims their item is fake, but without evidence they can't simply tell them that they can keep it and still get a refund. If they did, there are plenty of buyers who would go on a shopping spree and later "discover" that all their purchases were fake!
