basically i waited ages for a CD to arrive so opened case for "non receipt" and then i finally recieve it and its scatched and scuffed beyond belief. SELLER wants me to close case for non receipt and re-open on as "item not as described" etc ..
is this possible? i'm sure years ago i had something similar and i wasn't able to re-open on a previously closed case.

No ...you can open a SNAD case even if you have opened a INR case under ebay's Money Back Guarantee if it's within 30 days of receipt. If you encounter any problem you can open a SNAD case on pay pal... Pay pal give you longer... 180 days after the sale ... to open a case. You should get return postage paid by the seller for SNAD. Don't request a return for change of mind.... It's Significantly Not As Described.
