I've recently been the only bidder on an item saying the chess set has jade carved pieces.
In the description the seller then says they are unsure if they are jade.
Now its arrived they are clearly not jade but some sort of resin.
Is this deliberately misleading to lure the buyer? Is it legal?
I'd appreciate your advice.

It is pointless to contact the seller. The answer in short is it is not as described if you think it is not as described.
Please stop this delay. Open a "not as described case" now in the resolution centre. The seller should send a label to return within 3 business days. Do not argue with him or take any notice of what he may say "eBay said". If he does not send the label then escalate the case to eBay for a refund.
EBay never sees items, does not look at photos and has no way to investigate. Because of that they nearly always find for the buyer.
