"damaging items for a free return or saying not arrived when it has or saying not as described for a refund when it is?"
How do you know the buyer got the item unless you have tracking, in which case you would win a dispute.
How do you know the buyer damaged the item and it did not happen in transit.
Seller says as described, buyer says not as described and eBay never see the item to know who is being truthful - so they back the buyer in an attempt to put both parties back to their original position.
ADDED = leaving false positives for buyer's you don't agree with can only damage your account as it's serious feedback abuse.
