If the dress said on the label the size you ordered even if it did not fit then it was as described and the dispute was a return which is what you opened
If the seller is a private seller and has No returns on their listing then they can refuse to accept it back.
If it just did not fit then sell on yourself
Ebay wont step in it was between yourself and the seller
Had it been a not as described then it would have been different and the seller would have been forced to accept it back
You should always check before buying if the seller has REturns accepted on their listings. It is also a good idea if the measurements of the garment are on the item you are buying
