Person manage to return the item but he only return an empty box, which is a disgrace, the person stole my item and he has receive back his refund, please can you help me on this, I am very annoyed and the person has scammed me
This is very sad but we here are members like you not eBay.
Did the buyer open a case with eBay and did you send the label for him to return the item. It seems odd that you say that eBay has already refunded him. That should only happen if you did not deal with the case promptly.
Report to Action Fraud On Line. They will issue you with a Crime Reference Number. Then enter "Appeal Ebay's Decision" into Help and Contact at the top of the Page and follow the instructions.
We are members like you, we can only give advice, there is nothing we can do about this sort of buyer.
All you can do is use the "Report a Buyer" for abuse of the Returns process. It won't get you a refund and ebay will not tell you if they take any action against the buyer.
I am afraid this is one of the many risks of selling on ebay.
