Returning item and seller refuses return

How do a get seller to stand by his/her product as have baught phone and its broken and spent a lot of money to get told wont be refunded

Ignore what the seller says and follow the instuctions in ebays money back guarantee. Your item does not match the sellers description.  He will not only be made to refund in full, but he pays the return postage too.

Open a Return Case in the Resolution Center for Item Not as Described.
Wait for the label to print off from the Seller.
If the Seller doesn't provide the label or is unhelpful, you can ask ebay to step in after 8 days.
