I returned the item via the courier and did not accept it because it did not arrive during the time period specify and the seller did not contact me to advise me ofthat.
I advised the seller before it arrived that would be doing so .
I realise I should have contacted ebay before I did that.
The result is that the seller has their goods and my money and refuses to refund.
Any advice?
Thanks
red-magpie beat me to it - your money back guarantee has been completely voided by your actions.
You may want to try nicely asking your seller (assuming the item is now back in their possession as you say) if they wouldn't mind sending a refund minus all their associated costs (postage, selling fees etc). And adding how sorry you are for the inconvenience you have caused them.
But if your tact level is on a par with what you have demonstrated here, I wouldn't be holding my breathe.
Just out of interest - just how time critical was the arrival of the item? Are you aware how much things have slowed down recently due to people having to self isolate (again) ?
By refusing the delivery you automatically made the purchase ineligible for eBay's money back guarantee, see:

The irony is that eBay recently extended its money back guarantee, enabling items that arrive after the latest estimated delivery date to be treated as not as described, and returned at the seller's expense for a full refund:
|
The item arrived after the latest estimated delivery date |
Covered
The return is treated as if the item didn't match the listing. |
As you realise that is not the way to deal with problems
There is no return or dispute for late items
You can try and open a not recieved dispute but if the item tracking says Delivered then you would lose.
