hi the company are now sending me private emails asking for the return of the refund  are they just trying to avoid paying  the eBay fees  I keep telling them through the eBay messages that they are not allowed to contact me outside of the eBay messages not getting any where with this can anyone help

you were mistakenly refunded by a seller and they want you to repay the money - you request legal advice.

Legal advice can/should only be taken from [as said] a lawyer, however, adding to pixiesen2012 advice -

If a person is mistakenly given [refunded] money they are legally obliged to repay it.

Hi thank you for your message have been trying to get some legal advice
and i have been advised that I really don't have to make a refund back as
it was because of the company negligence also as the item was sent as s
gift it is nolonger my property they cannot collect as it was given in good
faith as a gift kind regards 😊

as said, if you want legal advice you need to talk to a lawyer, no one here or on ebays CS phone lines will be able to give you legal advice, but I find it amazing that you are even considering not paying for the item!

Hi as the company was negligent I don't have to make a refund also the
item no longer is my property as it was bought as a gift and it was given
in good faith they can't now collect it regards 😊

so, a company made a mistake and accidently refunded you for the item that you have received,

and they would now like you to pay for the item

they cannot be repaid through ebay as the option to do this doesn't exist

any decent honest person would pay for the item that they have received.

so, you'd quite happily keep the item and the money when it is clear the seller made a mistake, you won't get any 'legal' advice here, you need to talk to a lawyer for that,
