No they can't. If a buyer finds fault with an item you have to send a pre paid returns label, and get the item back before you refund, so they get nothing for free.
No returns is only for when a buyer has simply changed their mind - not for when items are faulty or misdescribed.
Your terms cannot over ride ebays.
