Making me wait for a refund

I recently purchased an item from a seller whose description did not include the damage to the item. He agreed to refund but is waiting till the last possible day before eBay steps in to make him do it. What can I do?

You can escalate the case to a claim from 8 days after opening and eBay should step in fairly swiftly.

You cannot speed the case up unfortunately, it is what it is.
