Lost item sent via Hernes

I sent a woodworking machine, a dovetail router to my buyer, having booked through parcel2go and using hermes.  A few days later my buyer posted pics of the item he revieved, a shoe box containing a pair of shoes! My label had been cut away and stuck crudely onto the show box with lots of brown tape, I have photographic evidence of this. Hermes after 28 days of investigating say I should take this up with parcel to go as I booked either them. Firstly is this the case, and secondly I wish to pursue this through the small claims courts. I did take out insurance. I have emailed hermes saying I suspect fraud has been committed and will be taking them to court. I need to know is it them or parcel to go I should be suing here please? Parcel2go also have a policy of making a claim within 28 days, no doubt hermes knew about this too.

You would have to sue the company with which you have a contract, i.e. that you paid to deliver or arrange the delivery of the item. Read their terms and conditions carefully first.

 

You haven't asked, but I presume you realise that you can't wait for this before refunding your buyer.
