Item lost but seller refusing to contact royal mail

An item was marked as delivered but the postal worker left it in a communal area when he wasnt instructed to do so.

Ive spoke to seller and they are point blank refusing to contact the royal mail and have told me they wont be making a claim.

They have mentioned that their "account manager" as advised against it.

Ive spoke to Royal Mail twice and they have told me the contract is between seller and them. Any advice? Thanks

This is one of the risks of buying on eBay. EBay can't and doesn't attempt to investigate disputed deliveries. They decide cases solely by the tracking record; if this states that it was successfully delivered to your address, that's the end of it.

Most ordinary Royal Mail parcels may be left in a safe place, but I wouldn't have thought that a communal area could be classed as safe. It seems to me that a complaint would be entirely justified. I don't understand why your seller is being so stubborn about this, but unfortunately it's true that only the sender can complain to Royal Mail. Are they a business seller? If so, they may actually be responsible on law for any negligence by their agent, in this case RM. But as so often on eBay, having rights doesn't count for much if you can't exercise them.

If the item shows as Delivered on the tracking/code then the seller does not have to do anything 

Ebay will go with the seller 

It is up to you to get onto RM and push the problem as to where your item is

Contact citizens advice and see what they say to do

RM would usually only deal with the seller as they are the ones that paid the postage

but they dont have to

If you have tried your local Delivery office then go higher 

Try the RM online site and put in a compliant loud and clear

If the tracking shows delivery at your address, even if left in common area, RM would not pay compensation, and I'm afraid ebay would not insist that the seller refund your money.

 

If  you're address is insecure there are arrangements you can make with your post office to keep your mail safe for collection.
