Dirty item that didn't fit

Item received was muddy and covered in pet hair. I've asked for a refund and they refuse saying that the size was stated. They didn't mention condition( with hindsight I know why!

Have you opened a case for 'not as described' (dirty, stained etc)?  If so, then you need to escalate the case to eBay after 8 full days and follow the case instructions.

If you simply opened a returns case (does not fit) then a private seller can refuse to accept the return.
