Charged different final value fees in the same category

Hi all, thanks for your time! I have a few listings in the DIY Tools & Workshop Equipment category which I am being charged different final value fees. Either 5% as it should be, or 10% for some reason.

Note: I am a recently registed buisness seller and dont have a shop subscription.

Here is an example: 

Bosch Set: 303799118687 listed for £29.98 being charged £3 FVF (10%):

DeWalt Set: 303733476374 listed for £29.89 being charged £1.79 FVF (5% + VAT on fee):

Both these listing are in the EXACT same category: Home, Furniture & DIY>DIY Tools & Workshop Equipment Which according to eBay's buisness fees page should be 5% + VAT

I've spoken to eBay live chat and they said it was because I was not a Shop Subscriber, however this is not correct as eBays buisness fees page says Subscribers benefit from FVF caps, the basic percentage rates apply to everyone. This would also not explain why I am charged 5% on some listings and 10% on others, upon challenging this through eBay chat I was transferred to another adviser who did no respond for 10 minutes and disconnected.

Do any community members have any insight what is the reason for this discrepency?
