A buyer purchased an item from me. It was well wrapped in large quantity of bubble wrap and the glass separately wrapped as well. The frame of the lantern, which is the item I sent, snapped and the buyer sent me one picture of my bubble wrap spread open with the broken lantern in the center. No photo of the damaged box, which is a requirement from the courier company, who is willing to refund me after I supply photos of 1) the broken item (which I have from the buyer), 2) a photo of the damaged box (which I have asked the buyer to send but he failed to comply, in the full knowledge that sellers HAVE to refund, as the buyer is always right with Ebay). So he is oblivious to meet the courier's requirements. In other words, he is obstructing my claim to the courier, as I will not be able to get the refund from their insurance.
The second issue, which is sly and despicable is this: this morning Ebay emailed me stating that I must refund the buyer because he opened a claim that my item WAS NOT AS DESCRIBED! In the refund claim, he did not state this, he said "Item arrived damaged" and asked for a refund.
How can one say in the description that an item WILL BE broken in transit? This is not failing to describe an item accurately! The buyer either realises the implications of his two-sided claim and could not care less, or he is unfamiliar with the fact that his lie will have two consequences. The first will be that my DSR will be affected, the second that the courier will not refund me, not just because the buyer does not supply a photo, but because a claim for Item Not Described is not insured and I will not get a refund from the courier.
It is known that Ebay always takes the side of buyers, even a buyer such as this one, who makes false allegations to one party (Ebay) and in his claim calls it a broken item.
I am sure many in the community will have encountered this type of unfairness about Ebay, as each time a conversation is about Ebay, the interlocutors (sellers) always have an anecdote to relate an anecdote about Ebay's biased conclusion when a claim is opened by a buyer, even when the buyer is proven wrong and at fault.
Not as described is correct case, buyer bought complete item, not broken one.
You are caught in the midddle, as ebay do not require buyer to send photos as part of case & if you don't provide returns label or refund, ebay will force you to.
Ebay is biased towards buyers, so sometimes you have to accept the loss.
