This is my original advert for my items. Type in the 3 item numbers he's selling and you'll see there the same I sold Games under the Item ID 235610497512. He stated they weren't delivered and was refunded £51.55.

That is not right at any level but it is going to be very difficult to do anything about it other than to contact the buyer - keep it polite but abrupt to the point - saying that you can see that he has now received the items and he has a choice to return them or pay for them indicate that as you are the owner of the goods he should not try and sell them, should he do so you will have no alternative but to start legal action against him, advise him to let you know what he would like to do within the next seven days to avoid such action and see how he reacts - you then have a choice to make

The lesson to take from this is to send orders out tracked especially a £50 item - if it cost £3.50 a couple of quid more with EVRI , Yodel or RM that way you are protected from this situation

Thanks for your advice. I did give him the 7 days and kept it polite and then reported it to ebay. They both haven't yet replied

You can after the 7 days send a letter before action - send it snail mail - still costing you nothing really but if he continues to ignore you - you have a choice risk a small claims or forget about it and move on.
Personally I would send the letter - then if nothing put it down to experiance
or if you want to apply more pressure you could send a letter demanding payment and an invoice with specific time to pay - then if nothing debt collectors or a series of demands / reminders each escalating the threat of action
Not sure you will get anywhere but it will make the point

Thanks for that I like that. I will send a letter even if he sticks it in the bin. By not replying to any messages stating that I've caught him out, shows that he did receive them. If you were totally innocent you would reply and say I've got it wrong.
