By mistake I sent different desktop to a buyer , he received and kept it , when contacted him he admited I refunded him the cost of the pstage in order to send it back to me , I post the right desktop to him , today he messaged me he wont be able to send back to me because he gave it to one for his birth day I checked his listing he list the processor which is i7-9700 . I tried to contact Ebay if they can help but are not reachable , any advise

If you post in Discussion > Selling you will receive a quicker reply.
In this instance you should follow eBay policy, as it is there to protect you. If you don't, eBay can't help.
If it were me I would have done two things besides apologise profusely:
1) asked the Buyer to open a Return Case for this Not as Described desk, issued a return label within that case, and refunded when the desk was returned.
2) relisted the correct desk and politely asked the buyer to purchase it again.

Has he confirmed via messages receipt of both items? That is crucial for taking it further. If so...
Take a screenshot of his listing. Tell him that, along with the messages you two exchanged, you have enough evidence to take him to court. Say you will take him to small claims court if he doesn’t return the first “desktop”, as he agreed.
