bought a Karoke machine off arrived damaged and not working. This was retunred but prior to sending back i messgaed him mentioning the damage. he got it back sent me photos of the damage i had mentioned and tried to blame the way i packaged it despite telling him before return. he refuses to refund and e bay seems to make it hard for buyers. i am now the £100 out of pocket plus the £22.98 it cost me to return.

if you had opened a not as described case you would not have been out of pocket.
as long as you are within 30 days of you receiving the item, open a case now, upload tracking proving delivery and escalate it to eBay on day 4 for a full refund -

If you had followed the Ebay returns process via the MBG it would not have cost you anything to return it and you should already have received a full refund.

eBay provide a Money Back Guarantee - the seller doesn't get a choice about whether you get a refund. It is GUARANTEED, but you must follow the correct procedure.
Go to the item in your purchase history
Click "More Actions"
Click item was not as described
Enter your tracking number into the case notes
After 4 days, click on "ask eBay to step in" and you will be refunded in full
Never post the item back to the seller yourself, the seller is required to provide a pre-paid postage label so you can return the item at no cost to yourself. It's too late this time and you can't get the postage money back, but in future, always open a case, don't deal with returns outside the Money Back Guarantee system
If you have no tracking number proving delivery then you have lost your money

But you did'nt follow the process hence you lost money.
Open case seller/ebay send you a return label free to you in cases of damage.
You return in 4 days get a full refund
What was hard about that oh yes you wanted tracking ebay label have tracking automatically
If seller send his own untracked label then thats his problem.

If you had opened a case correctly the seller would have been forced to pay for the tracked return postage but it is too late now
Just open the case, enter your tracking number and "ask eBay to step in" on Day 4 to get your guaranteed refund

If you try to return an item outside of the eBay Money Back Guarantee then if it all goes wrong eBay you'll be left out of pocket. The returns labels supplied by eBay always have a tracking number included on them, so as long as the tracking proves attempted or successful delivery back to the seller you should receive your money back in full.
