did not recieve mobile phone only a box with a charger in

i never recieved my a12 mobile phone off     ejmarkd  only a samsung box cotaining a charger only  and now he says he has refuned me but i have not recieved a refund under the ebay gaurantee the case was dismissed in the seller favour   ejmarkd i think i have been scammed out of £71.17p

You have to open a return because the tracking will show delivery so a "not received" case won't work.   So start a return on here:

select "Doesn't match description" and escalate it to eBay after 3 complete working days.
