Why do ebay not care about selling fakes

So I buy a lot of cards on ebay, have done for a while, yet there are so many fakes being sold, I'll message the sellers letting them know there fake, 95% of the time they say im lying or dont care, I report the item to ebay, they always without fail say it dosnt go against there community standards, I always appeal the decision, and again, always without fail ebay come back and say they've looked into the claim and still say it dosnt go against there community standards.

I dont see how it's not against there community standards to allow people to sell cards/collections worth hundreds, sometimes thousands of pounds.

Theres a page on fb that highlights some of the more expensive cards, get mass reported and still nothing gets done.

Why do ebay not care about selling fakes

There is absolutely no point in reporting fakes to eBay for several reasons:

 

1. Reports are primarily dealt with by eBay's Artificial Idiot software, which simply is not advanced enough to deal with such reports. For example if someone reports an item as fake eBay's AI scans the listing's Item Specifics and, because there is no mention of the item being fake, deems that it must be genuine. An eBay employee looking at the same report will take longer but reach the same conclusion.

2. eBay uses the "we're just a platform" defence. That may be true - they never see any items sold on the site - but using that as a reason for inaction, and not investigating reports when made, renders the site a risky place to buy anything, let alone anything of value.

3. Section 2 of eBay's User Agreement states that eBay "does not guarantee the existence, quality, safety or legality of, items advertised; the truth or accuracy of users' content, listings or Feedback; the ability of sellers to sell items; the ability of buyers to pay for items; or that a buyer or seller will actually complete a transaction or return an item". In effect it's up to the seller to be honest and it's not eBay's fault if they're not.

3. Money. eBay makes money from sales; it really doesn't care whether the sales are of genuine or fake items. The onus is on the buyer to know what they are buying and to make use of the Money Back Guarantee if they discover that what they have purchased is not what was described. That, however, relies on the buyer knowing that the item is fake - a significant number do not, or find out after the 30-day MBG period ends, and that favours eBay.

 

The only action anyone can take is to open a Not As Described case, have the seller provide a return shipping label and obtain a refund. eBay doesn't care whether someone is selling a fake or if someone has bought a fake - if the item is returned as NAD eBay refund the buyer, end of. The fact that not all buyers of fakes open NAD cases because they are unaware that the item isn't genuine is in eBay's favour because they keep the commission.

 

It's very much a case of caveat emptor. And there's no point in wasting your time reporting fakes because no action is ever taken. eBay is not bothered about policing their own site - and users shouldn't have to do it for them.

Individuals can still report counterfeit items to eBay, but how to report them has changed in recent years.

 

Best is when you've purchased a fake is to return it and leave Feedback that will stick.

 

When you haven't purchased the item, best to let the rights' holder know so that they can report a VeRO issue. (Individuals cannot report to VeRO anymore, as you have noted.)

 

Next best is to use the A Problem in the Listing reason:

? icon > Submit Report > Product or Listing > A Problem in the Listing then depending on the situation I think these are the most useful:

> Search Manipulation (including a Brand name in the title that is unrelated to the item)

> Unauthorised Use of a Trademark (using a Brand name for an unbranded or other branded item),

And to add, a single complaint on an item won't achieve anything.

 

You might just be a competitor in the same field just wanting to get rid of the compeition?

 

And the usual eBay excuse - they don't see the item so how do you prove it to them that it is a fake?

 

There's always been fakes and there always will be, regretfully  -  it certainly doesn't make it right - it's just the way it is.

 

Bottom line -  sad, but true  -  eBay don't care.
