I recently posted a wanted advert on Gumtree and received a response from someone named John who offered me items which I could buy from a friend of his. He sent me a photograph of the items (antique dining chairs) and they were perfect for me. I was asked to pay his "friend" on BACS which I mistakenly did but the items were not delivered in spite of numerous promises. I subsequently noticed the exact same photograph on an ebay sellers list. I contacted this seller and he has never heard of this John person or his accomplices.
It appears that he copied the photograph from the ebay seller's listing and posted it to me purporting to be the items fhis friend has for sale.
I wonder if this person is in breach of any ebay rules or maybe copyright of the ebay seller as he did not give permission for his photograph to be used.
Any comments would be interesting.

I'm sorry to hear of your experience with this seller from the gumtree platform. As the transaction or communication didn't take place on eBay there wouldn't be anything that eBay can do. I would recommend to report the seller on the gumtree platform and you can also report it to the police for fraudulent activity. The police can then contact eBay for help in the investigation.
