It’s now ok to list used item as new?!?!

Today I reported a listing for an  item which has 'new' in the title and specifics but seller has put that it's been worn once in the description. I asked the seller for clarification and was told they'd only worn it twice.🤔 Seller is not going to change the listing.

EBay's reply to my report stated that it had been checked by a customer service agent who has concluded that there was no problem with the listing.  Obviously EBay now considers it is perfectly acceptable to list a used item as new.   What?!?! Is this what we've come to?

Some items can only be listed as NEW ,things like perfumes etc.

I guess the phrase "buyer beware" springs to mind.

Reporting (even if there is an option) is like throwing a penny in the sea and hoping a magnet will find it.

Thanks for your reply. It was clothing so it's very straightforward to list correctly if a seller wants to. It's bad enough to be told AI doesn't see a problem but an agent? Either eBay is lying or the agent didn't do their job.  I've been on eBay since 2004 and it's no surprise but it's frustrating nevertheless.
