I bought a cd and i got an empty packet,they won't answer my Emails to sort this.Ebay send me in a circle.

You have to open a return. A "not received" case won't work because the tracking will show delivery.
So start a return on here:
https://www.ebay.co.uk/help/buying/returns-refunds/return-item-refund?id=4041
select "Doesn't match description" and if necessary escalate it to eBay after 3 complete working days.

You return the empty package - though the seller may just refund without requiring a return.

You did receive an ' item' albeit an empty package, so the case you must open is one for item not as described.... Does Not Match Description or Photos.
Should the seller wish for the ' item' to be sent back, you send back the empty packaging at the seller's cost, they then have 48 hours to refund you, if they don't , you must escalate the case, and eBay step in and force the refund.
Do Not open a case for item not received, here the seller may enter a tracking number this shows delivery of ' an item', and the case would close in the seller's favour.

Don't use eBay for any dispute, I always use PayPal and eBay seem to never get back to PayPal so always win the case.

There is no reason to not use eBay's Money Back Guarantee first. Buyers are usually extremely well protected and if for some reason the case isn't found in your favour you will still be able to try a PayPal one subsequently whereas if you go straight to PayPal you won't then be able to use eBay's Money Back Guarantee.

PayPal is far better. Never lost a dispute this is due to eBay never coming back on an PayPal dispute. As for the money back guarantee, it isn't guarantied. I and others find this is the far better way. eBay is not the way, so will not ever use eBay protection. I don't use eBay much now, I used to spend thousands a year and now down to a few hundred. as most sellers charge more than you can easily get on other platforms, also the amount of fakes have drastically increased. I used to be a seller on eBay for 15 years and gave up selling about 10 years ago on eBay.

adding to the advice already given -
"PayPal is far better"
with PayPal the buyer has to pay the return postage and the return could be to the address the seller is registered at.
