Damaged and second hand items sold as new

Last few purchases have been really poor.  New items that are clearly used  returns, some damaged and unchecked.  Items not matching the description, ambiguous descriptions.

Generally feels like 'anything goes' these days presumably because there is no effective penalty.   Yes, it can be escalated or sent back, but I believe that some sellers know that most buyers can't be bothered on lower cost items and would accept a discount rather than upload photos, enter multiple chats and suffer the delays in resolution or simply put up with the shoddy product.   I'm not actually getting what I ordered.

What are the penalties for sellers for this sort of behaviour ??

Well,  it does help to open those cases,  it may not show that eBay is taking any action it's not obvious on a seller's account, but if too many cases are opened,   resulting in above average refunds in percentage number to the number of sales,  they will take action.  They'll serve selling sanctions or even bans from selling.

eBay don't like disappointed buyers,  they tend not to come back, so yes,  eBay do take action against bad sellers,  but only if buyers take the time to open those cases.
