my hermes claim delivered and signed for but not received

I am having trouble with my hermes. Their tracking shows delivered and signed for but I have not received my parcel. 

 

I came home from work and found a note through my door saying that a parcel had been left in the bushes at the front of my house but could not find it. The bushes are about 1m deep, then there is a public footpath, on the other side of the path is a communal garden with seating.

 

There is no way of speaking with my hermes on the phone, I tried messaging them but was getting little response so ended up using the resolver.co.uk website. Through this they have eventually admitted that the parcel was left in an unsafe place and asked for the seller to contact them, he will no longer reply to my messages as he has been paid and obviously knows the system. 

 

So I submitted my not received case to ebay, with a copy of the delivery note and casefile from resolver, this has been rejected as the tracking shows delivered and signed for. Ebay want a headed letter from my hermes or the tracking corrected but my hermes refuse to do either. So I submitted evidence to paypal and they also refused due to the tracking information. 

 

I have now made a direct debit indemnity claim via my bank and have had the purchase money refunded to my account, although it has been pointed out that it is likely that this will be challenged. Is there anything else I can do or try to help my cause?

 

What makes matters worse is that I had paid extra for royal mail next day before 1pm delivery, the seller then sent out a week later using the my hermes 5 day service. Ebay also tell me that this is not breach of contract so I have no right of appeal down that route.

EBay will support the buyer 100% when an item isn't as described, yet won't help when a seller doesn't use the postal service that was advertised and paid for.

 

This goes back to the time when eBay wasn't involved at all with postal charges. Now that they charge a 10% fee on the postage cost, eBay should take some responsibility. The buyer deserves some support when the seller uses an inferior service. The difference between using Royal Mail and a budget courier can mean the difference between a parcel being received or not received.

The fact that your bank has refunded you is a good thing, but if they`ve taken the funds from the seller and he challenges the descision by proving the item was delivered, they may very well give him the money back.

This is getting a ridiculous situation on this site and is happening too often for my liking, but i`m afraid there`s not much that can be done, because as far as ebay are concerned, it`s been delivered and won`t entertain any refund claim. i notice you state the item was signed for and normally, i`d asked what the name was that signed for it, but the drivers are signing these delivers themselves at the moment, or entering a code, so there`s no way of checking.

i do know that hermes drivers are asked to take a photo of where they put the parcels now, so if you can get hold of them and they`ll share it with you, you could ask if they have a photo.
